HOW TO ENTER THE SWEEPSTAKES:

Copa Food City 20th Anniversary Sweepstakes will begin on Sunday November 5, 2022, at approximately 12:00 a.m. Mountain Time (“MT”) and end on November 24, 2022 at 11:59 p.m. MT. All Food City locations are Participating* (see list below). Odds of winning depend upon the number of eligible entries received. To be eligible, entries for drawing must be received on the designated Food City website after 12:00 a.m. MT on November 5, 2022 through November 24, 2022 at 11:59 p.m. MT (the “deadline”). Any mail-in requests must be handwritten and must be postmarked no sooner than November 5, 2022 and received no later than 11:59 p.m. MT November 20, 2022. The final Entry Deadline is November 24, 2022 at 11:59p.m. MT to be eligible for the Grand Prize.

There are two ways to enter the sweepstakes, enter via either of the following methods:

a. Each eligible participant (see eligibility requirements below) purchasing $20 or more of qualified purchases (in one shopping trip) at a participating Food City location will receive an Official Entry coupon through the Catalina Marketing coupon device with a Unique Number and instructions to entry. The following purchases do not count as qualified purchases: lottery tickets, event tickets, postage stamps, certain prepaid cards, gift cards, money orders and any other in-store services, alcohol, taxes, the portion of a prescription’s cost not paid out of pocket by the customer, fees, plus any other items prohibited by law. Entries must be completed on the printed website located on the Official Entry coupon. The online entry will require entry of the Unique Number, with the participant’s first and last name, a valid email address (if available), mailing address and zip code and mobile/cell phone number. Each unique number entered will create one (1) valid entry. There is no limit on the number of qualified purchases of $20 or more a customer can make, but each qualified transaction of $20 or more will only generate one (1) valid entry. Online entries must be entered online no sooner than 12:00 a.m. MT November 5, 2022 and no later than 11:59 p.m. MT November 24, 2022.

b. No purchase method. Each eligible participant (see eligibility requirements below) may send a self-addressed, stamped envelope to PO Box 97464, Phoenix, AZ 85060 with the words “Copa Food City 20th Anniversary Sweepstakes,” participant’s first and last name, a valid email address (if available), mailing address and zip code and mobile/cell phone number. Each mail-in, complete request will create one (1) valid entry. There is no limit to the number of mail-in requests, but there is a limit of one entry per envelope. Mail-in requests must be handwritten and must be postmarked no sooner than November 5, 2022 and received no later than 11:59 p.m. MT November 20, 2022.

Sponsor assumes no responsibility for incomplete, damaged, misdirected, illegible, late, stolen or lost entries. Entries become property of Sponsor.

 

ELIGIBILITY RESTRICTIONS:

The sweepstakes is open to participants who legally reside in Arizona and are 18 years of age or older at time of entry, except employees of Raley’s Arizona LLC (DBA Food City, Bashas’, AJ’s Fine Foods), Raley’s, Raley’s O-N-E Market, Capitol Millworks, Bel Air Mart, Nob Hill General Store, Inc., Warehouse Concepts, Inc. (dba Food Source), Riester Sonoran, LLC. Members of employee’s immediate families or persons residing in the same household are not eligible to enter or win. “Immediate Family” means parents, children, stepparents, stepchildren, siblings, stepsiblings, registered domestic partners, and spouses, whether or not living at the same residence.

All finalists must show a government-issued photo ID showing date of birth and one of the following: Arizona Drivers License, Arizona Identification Card, Armed Forces Identification, Immigration or Naturalization ID or Tribal Census in order to pick up their prize.

 

PRIZES:

One (1) Grand Prize Winner will win a $20,000 cash award. Five semi-finalists will be awarded a cash prize of $1,000.

PRIZE NOTIFICATION:

Each Finalist will be notified by email (if available) and phone as soon as possible by the Food City Marketing Department on November 25, 2022. If after a reasonable number of attempts (as determined by Sponsor in its sole discretion) contact is not made with a Finalist, prize will be forfeited and an alternate Finalist will be selected. All Finalists will be required to sign an agreement of acceptance, eligibility, and release of publicity/liability (“Winner’s Agreement”) within the time period specified by Sponsor in the letter accompanying the Winner’s Agreement (“Prize Letter”) or prize will be forfeited. If mail is returned as undeliverable without a forwarding address, then prize may be forfeited. An alternate Winner for forfeited prizes may be selected at Sponsor’s sole discretion. Prize will be awarded upon receipt of Winner’s Agreement, and verification of Winner.

The Prizes described above are as stated and may not be altered or exchanged. Prizes may not be assigned or transferred. No substitution may be made, except by the Sponsor, who reserves the right, in its sole discretion, to substitute a prize with another prize of comparable or greater value. Winners are solely responsible for any and all applicable fees and taxes expect as described in the prize description. Any trademarks or names used in this promotion are the property of the respective owners and are used for identification purposes only.

 

SELECTION OF WINNERS

Decisions of Food City Marketing Department with respect to the sweepstakes are final. Starting on November 26, 2022, the Copa Food City 20th Anniversary Sweepstakes prizes will be awarded at the Food City store located at 845 W. Southern Ave., Phoenix, AZ prior to 12:00 pm MT. The Winner will be selected from the six valid semifinalists via random drawing.

 

AWARDING OF PRIZES:

• The Grand Prize Winner will receive $20,000 at a mutually agreed upon date and time, once all necessary documentation has been completed.
• The five remaining finalists will receive $1,000 at a mutually agreed upon date and time, once all necessary documentation has been completed.

 

GENERAL CONDITIONS:

By participating, you accept and agree to abide by the Official Rules and all decisions of Sponsor and its judging and administration organizations, which are final and legally binding in all respects. No substitution or transfer to a third party of all or any part of prize permitted. If, for any reason, a prize cannot be awarded or winner is not capable of redeeming a prize, Sponsor is not obligated to award it and Sponsor reserves the right, in its sole discretion, whether or not to substitute the prize (or portion of prize) with a prize of comparable or greater value or cash value. If, for any reason, more prizes are available or claimed than the stated number, Sponsor reserves the right to randomly draw winners from eligible prize claimants in such prize category.

Entrant irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant’s Submission, including, but not limited to, the recording and the performances contained therein (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Entrant’s name, likeness, photograph (collectively, “Likeness”), and/or statements regarding his/her participation in this Sweepstakes (with or without using the Entrant’s name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor’s use of the Submission and agrees not to sue or assert any claim against the Sponsor for the use of the Submission or Entrant’s Likeness or statements.

Winners are solely responsible for all federal, state and local taxes unless specifically included in the prize description, on prizes and any expenses not specifically awarded in the Official Rules. Winners will be required to sign an IRS Form W-9 or the equivalent and a Winner’s Agreement and release form (the “release form”).

Non-compliance with these Official Rules may result in disqualification. You are not a winner unless and until you have fully complied with the Official Rules and all verification and award processes have been completed. Acceptance of prize constitutes permission for Sponsor and Suppliers and its/their designees to use winner’s name, image, and/or likeness for purposes of advertising and promotion in any medium, without further compensation, except as prohibited by law.

Sponsor is not responsible for typographical or other errors in the printing, the offering or the administration of the Sweepstakes, or in the announcement of a prize.

RELEASE OF LIABILITY:

BY ENTERING THE SWEEPSTAKES, YOU HEREBY AGREE THAT IN NO EVENT WILL SPONSOR OR SUPPLIERS OR ANY OTHER RELEASEE BE RESPONSIBLE OR LIABLE FOR, AND YOU HEREBY RELEASE THEM FROM, ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LOSSES, COSTS, EXPENSE OR LIABILITY OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURIES AND/OR DEATH, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND COUNSEL FEES AND COURT COSTS) ARISING OR RESULTING FROM ANYTHING RELATING TO:

• THE PRODUCTION, PROMOTION, ADMINISTRATION OR EXECUTION OF THE SWEEPSTAKES (OR YOUR PARTICIPATION IN IT);
• CANCELLATION, MODIFICATION OR RESCHEDULING OF ANY ASPECT OF THE SWEEPSTAKES;
• USE OF ANY WEB SITE(S) RELATED TO THE SWEEPSTAKES OR MATERIALS ON THE WEB SITE;
• ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE; OR
• PARTICIPATING IN OR TRAVELING TO ANY SWEEPSTAKES-RELATED ACTIVITY.

“RELEASEES” MEANS SPONSOR, SUPPLIERS, ALL SWEEPSTAKES PARTIES, SWEEPSTAKES PROVIDERS AND ALL OF THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES AND SUBSIDIARIES, AND ALL SUCH ENTITIES’ EMPLOYEES, OFFICERS, SHAREHOLDERS, DIRECTORS AND AGENTS.

 

LIMITATIONS:

• Neither Sponsor nor any other Releasee is responsible for:
• Lost, late, damaged, incomplete, illegible, stolen, misdirected, or postage due mail, shipping or email;
• Any website, computer, telephone, satellite, cable, network, Internet or other equipment, electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues;
• Unauthorized access, tampering, hacking, theft or destruction; or
• Other technical or human error in the receipt or processing of entries, game piece requests or other submissions (whether to or from) or otherwise related to the production, promotion, administration or execution of the Sweepstakes.

 

TAMPERING/VIOLATIONS/DISRUPTION:

Sponsor may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Sweepstakes or acting in violation of the Official Rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

 

CAUTION:

ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

 

CANCELLATION/MODIFICATION:

Sponsor may, in its sole discretion, cancel, terminate, modify or suspend the Sweepstakes if the Sweepstakes is not capable of running as Sponsor planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Sponsor, in its sole opinion, deem could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Sweepstakes).

 

NO PRIZE WARRANTY:

WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.

 

DISPUTES:

SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF ARIZONA. IF NOT RESOLVED THROUGH DIRECT DISCUSSIONS, ANY CLAIM SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION WITH AN EXPERIENCED ARBITRATOR LICENSED TO PRACTICE LAW IN CALIFORNIA. FORUM AND VENUE FOR ANY ARBITRATION PROCEEDINGS WILL BE IN CHANDLER, ARIZONA. THE REMEDY FOR ANY CLAIM SHALL BE SUBJECT TO ALL LIMITATIONS AND RELEASES SET FORTH IN THESE RULES, BE LIMITED TO ACTUAL OUT OF POCKET DAMAGES, AND SHALL NOT, IN ANY EVENT, INCLUDE ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ATTORNEYS’ FEES OR COSTS OF BRINGING A CLAIM, OR ANY INJUNCTIVE OR OTHER EQUITABLE RELIEF.
